Bonjour, quelques généralités en concentré pour te donner quelques bases importantes de la problématique posées. Bon courage.++

    Explications :

Carrying arms, as a right, has its roots in the tradition that the defense of the constitutional system rests on the American citizen himself. America today claims the legacy of the Wild West. At a time when borders were not well defined and the police were underdeveloped, it made sense to keep the community in order, and to allow everyone to carry a weapon.

The Second Amendment is directly inspired by the British Bill of Rights of 1689 which states that "Protestant subjects may have in their defense weapons permitted by law." This right, like the others, guaranteed by the Bill of Rights, is granted "for the purpose of informing that religion, laws and liberties could no longer be in danger of being overthrown".

Since that time, minds have changed. The right to bear arms is no longer of a collective nature, although some citizens do not hesitate to invoke it.

The rise in crime has led to a series of federal laws designed not to prohibit the possession of weapons, but to limit it.

But this approach was quickly censored by the Supreme Court. Currently, the debate is developing on the possible ban on semi-automatic weapons (assault rifles) considered particularly deadly.

In any case, the Supreme Court still sanctions the initiative of a federated state that would venture to prohibit the possession of weapons.

In these circumstances, there is very little immediate chance that case law will evolve.
